partial cancellation of sale agreement

Dear Sirs

A sale agreement (agreement for sale) was executed by one Mr.Kannan to Mr.Kumar for 10 Acres of landed property. The time agreed between the parties was six months. Out of mutual understanding of both the parties, in respect of a particular five acres , the sale agreement was cancelled. Cancellation document was signed by both the parties. And the advance money whatever applicable to the five acres was also returned back to Kumar.

Normal cancellation of sale agreement will attract only Rs.50/- registration charges. Thats all.

But, will this partial cancellation of sale agreement for specific properties attract more stamp duty and registration charges?

no. The stamp duty at the time of registration shall be charged as if the original agreement was for only 5 acres of land and no additional stamp duty shall be required in the name of cancellation of some part paroperty attached with original agreement.
