I know that on a commission of cognizable offence, an FIR is filed. This FIR should be produced in front of the Magistrate along with the accused if arrested.
My querry is:
1. What happens to the FIR if an accused has not been identified and hence not arrested.
2. Can an FIR be filed against unknown persons and presented before the magistrate.
3. What does the magistrate do if accused is not known.

Once the F.I.R. has been registered the investigation in the case shall begin.It is the duty of police investigation officer to identify and arrest the accused.

Ans. Investigation will be done and a untraceable report wil be given by the court.
2. Can an FIR be filed against unknown persons and presented before the magistrate.
Ans. Yes it can be filed and presented.
3. What does the magistrate do if accused is not known.
Ans. He will give untraceable report if police fails to find accused.
