Registration

Dear Experts,

The residential flat, I am living in is on name of My grand moth (Mom's Mom) and she is ready to give the same to her daughter by way of Gift Deed.

During Registration of Gift Deed, we have come cross that intial agreement was not registred i.e. bewteen seller and my grand ma, (Second Sale). The first was between builder and first party. Although we have paid stamp duty on same.

Now how to proceed? how to do the registration of gift deed?

Require urgent help on this.

Your query is not clear ,there is no cosideration on Gift Deed,the consideration is love and affection,so there is no need to initial agreement.Consult with a senior lawyer in your local area.

First u registration a sale deed of second sale (saller and your grand ma) then she is registration a gift deed in your name.

Gift deed can be regd.in your name,but sale agreement entered by your gm will become binding to you.

Thanks for your timely reply.

Presently our area comes under Forest Land and for registration they are charging something extra. In addition to that I was come cross a article which says that if you have bought/sold flat in co-operative society, registration is optional. The sale deed was executed in 1993.

Pls. confirm and throw a light in above scenarios.

gm means Grand mother.I  understood your querry like this that even if the previous sale agreement is pending whether your GM can still gift that property?So I have replied that gift deed can be executed in her daughter's favour,but sale agreement done by your GM,will be binding to daughter who takes the property by gift..
