I read that M/s. Dynamic Orthopedics Pvt. Ltd. ...Appellant(s) Versus Commissioner of Income Tax, Cochin, Kerala ... Respondent(s) case has been referred by the Hon' two judge bench to a larger bench.
THe case verdict was in feb 16, 2010.
Does anyone know the status of the case wrt larger bench?
Also I have a question regarding the applicablility of the case to the current Sec 115JB of the IT Act, 1961. Since 115JB includes two provisos that require the method and rate of depreciation to be the same as that of PnL laid in AGM does it mean that the decision of case does not hold good for 115JB and only applies to 115J?
