Society formed but not registered

I am in Process of Buying a flat in Resale in Loan at Navi Mumbai. which was constructed 12 years old.

I came to know that the society is Formed among the flat owners, but not registered and no formalities is in process since last 6 Yrs and no documents is submitted to society registrar and cidco till now for purpose of society registration.

But still Society is issuing Society NOC and collecting NOC Charges.

 

Please clarify that NOC issue is legally valid and will bank accept for Loan purpose???

as per bye laws, society should be registered within one year fro mthe date of formation of adhoc committee.

 

The society is in fault and they have no right to collect the charges for flat transfer and/or issue any NOC as they have no rights and power to do so.
