shrikant v. sathe (retired)     06 March 2017

Statutory violation

Sir,

We , the 25 applicants have made a complaint to the high court regarding retiremnt given by bank 3 years earler without declaring any VRS, scheme. We all were in officer cadre. Those officers who retired at age of 58 are on the equal standing as of us, but the bank had retired us at the age of 55 instead of 55 showing the clause in standing order The court has given the decision as if the complainant show to the court that the bank has made a statutary violation then the high cout will accept the case otherwise we the applicants have another forum to approach means labour court. If the bank thinks that the standing order applies to us then how it made the other offcers  retired at the age of 58.

I want to know  what is the section in statute or  constitution  which will definitely indicate that the bank has differentiated between same cadre  and did not follow the rule of equality.

Thanks

Yours Faithfully
