Wrong termination from company.

First of all build evidence ( audio/visual/minuted/witnessed) covering that you applied for leave and informed company…………………..tendered notice of resignation……..

 

Termination during notice period of resignation might be a bad order……………………….as the establishment has not any SCN to you and has charged with misconduct and has not conducted any inquiry..

 

 

Since you has duly resigned from official id and tendered notice of 15 days and employer preferred to not to allow you work during notice period…………………………….. (and terminated)……………..IT needs to tender notice pay to you for 15days+ earned wages till LWD.

 

You may write to employer, under proper guidance of your counsels specializing in Labor/Service matters………….

So it is okay for the company to terminate and just waisted my 2 years because i have no experience letter or anything.

should i take any legal action or not against to company.

You can also seek support from local unions  and IT/ITeS employee’s unions, Local counsel specializing in labor/service matters ……………………………………..covering all points, so that no burden of any misconduct is transferred on you.

I think you may not be able to draft your representations properly.

Before you approach; Discuss with elders and your counsels as suggested.

Try local unions also e.g;

PCMSRU affillaited with FMRAI.

They may agree and  embrace you.

 

OR IT/ITeS employees unions may guide you to local persons.
