Respected Sir/Madam,
My friend has a flat in one of the housing societies in Pune, Maharashtra. The flat is vacant since its completion. The maintenance was not paid for 3 years for some reason or other. Now she wants to pay all the charges immediately. Now society is charging 10% Non-occupancy charges retrospectively. The society audit took place a few days ago for the first time. No notice for delay or non-payment of charges was issued.
As per my understanding no non-occupancy charges can be charged for a vacant flat. I also read similar opinions online. But the society claimed there are some recent decisions so they can charge. What is your opinion? Can somebody point me to relevant supreme court or high-court judgments?
