Firstly the facts are not clear. The status of the Indian husband along with the wife is not clear. The facts must include:
- What was the status of the marriage when the woman left for the US? Were the husband and wife going to get a divorce sanctioned?
- Were the couple living separately when the woman left for USA?
- Was the man aware that she already had a husband living in India?
- Did the wife desert the man?
Complaint for cheating can be filed under section 415 of IPC in case the person hides the fact of first marriage.
Also, if the husband (who is in USA) knows that the woman has a husband in India and still marries the lady, there is no bigamy.
So, the facts need to be properly states, rest, the answer is mentioned above.
