Cancellation of fradulent registrations

Learned Sirs,

The Madras High Court Bench here has upheld the legal validity of a circular issued by the Inspector General of Registration on November 3, 2011, empowering the District Registrars to annul sale deeds if enquiries conducted by them unravel fraudulent registrations.

 

How ever when we approach the Registration Departments they are quoting that this order was passed by the Madurai Bench and even now stay against order is pending in the High Court of Madras. Telling this they are not conducting any enquiry into the cases of fradulent registrations. Kindly advice is this is true and what i need to do to make the Registration Department Take up the case

Yes, stay against order is pending in the High Court of Madras.

You have been rightly informed that there is a stay against this order. You cannot do anything against this.  For your information, please understand that with the given burden of heavy load of registrations in the registrars office, even if the stay is vacated, it will be difficult for the registrar to implement the ruling in full force for ever.
