Cheque bounced and person is absconding

Dear Sir/Madam,

I and some other peoples have been cheated by a person. he had taken money from us by cash. and in return he has given us cheques. he has asked us to deposit the same after 2 months. and he was running a internet center which was running well.

Now this person and his family is missing. and the shop is closed. we have lodged a complaint in the police station and cheques has been deposited and its bounced back.

what do we do next.

Building owner wants to make money by selling the materials which belong to the person who cheated us. how do we recover the materials.

Please suggest.

(Dear Mr.Kamal,

 

File a 138 Cheque Bounce Case after serving notice.

If the local PS does not register the FIR for 420(Cheating) then file a 156(3) application before local magistrate. 

File a summary civil suit for recovery and in that suit apply for attachment before judgment (O.38) so that the builder is not able to appropriate the entire proceeds of material to himself.

Dear Kamala when the person is missing with his family, you can not file 138 N.I.Act, because his limitation will be start after reciving the demand notice, he can be raise a question at any stage of the proceeding that he was not receive any demand notice, you should file a criminal case under section 420 IPC with relevant facts and evidence if you have.
