My sister got divorced on June 2007 from her husband when she hada girl baby of date of birth 20 oct 2002.
During the divorce process there has ben no claim and stettlement carried for girl child and neither my sister got it legally written the cutody fo baby with her nor her divorced husband claimed the custody.The baby has been admitted to school with her father name but her father has never been with her till date.My sister got married now second on August 2011 and now my sister second husband want to legally adpopt and they want legally my sister daughter to be with thier names.Currently my sister faced an issue while creating passport for my sister daughter where she has been asked for legall papers for my sister custody to the baby.
Since the birth of baby itself my sister was not living with her divorced husbadn ut got legally divorced on June 2007 when baby age was 4.5 years.
Kindly let us know the process to get the legal custody of child and get the child passport made with her second husband name or get second husband name on her legal proofs for the child.
