Child Int Maint HMA24: Can Empl wife ask frm Unempl Husband?

Page no : 2

Jamai Of Law (propra)     09 September 2010

Kumar Sir,

you misunderstood me again!!!!

The guy used to maintain a full team of 'charterd accountants' for his business in his good days of prosperity, once upon a time!!

But Now he works as full time volunteer and lives in the same ashram,

Owing to his qualification & credibility (Mech Engg-MS degree from US. worked in USA for 2 and half years came to india started business etc etc etc) he is definitely entrusted with admin tasks there in ashram, but he is a sheer devotee, and never EVER gets involved in any financial matters or neither has any powers.

But he is definitely paid by Ashram, in view of his daily needs as an allowance, which comes out 36k per anum flat, rest all food, clothing, medication, a room to live is for free.

He is a good orator and admin skills & very well & very able bodied and conducts yoga batches there on behalf of ashram, classes for students

But eveything as a service to community, that too I believe the administration there realised his potential and his self sudy in those areas, they thought to make use of him now.

He started all this full time volunteering after his wife left him and he had nowhere to go. Earlier he used to be just one of the devotees just like his wife.

Below '1 lac bracket' : I only meant that, on paper, he doesn't even need to prove his income by filing IT returns at present. and he has nothing to hide also about it as has no assets.

So neither he has renounced the world nor well paid. But wants to save his marriage although can't fulfil monetory expectations of his wife.

If she comes back he wud reduce this full time volunteering stuff and wudn't mind to take up a job also. but wife doesn't want to come back but wants maint from him. That too......... as interim maint which is given without going into the merits of the dispute.

If wife thinks he is useless, who would stop him from doing social activites. He is not a 'koluuu ka baail'.

Wife can't  give orders to him that he should earn minimum XYZ  per month.

Marriage is not contract but a secrement 'even in the black and white wordings of the law'.
