In accordance with the extant procedure, such suits could be filed.

If a similar suit is filed on the same cause of action you can file a petition under order 7 rule 11seeking to reject the plaint, however you may discuss with your advocate on all such further issues.

In civil suit instead of the term "respondent" it must have been "defendant" isn't it ?

How, why another defendant filed suit on you, wherein you are one of the 12 defendants ? If you are sure about your statement, which is prima facie fabricated, what is the case filed by another defendant ?

What is the opinion and advise of your lawyer ,who is well aware about facts and circumstances of the original (first) suit, an able, competent and intelligent enough to satisfy your queries besides the fact that s/he is engaged / paid by you for defending you in first suit qua second (fresh) suit stated to have been filed ? In such a case why do you need a second opinion and obligation of experts on this platform except the fact it is available FREE OF COST ?
