Consumer court

Is a  brouchure showing a Investment proposal for land purchase doesn't come under consumer court.

Where the brouchure shows u invest  amount(Rs100000) amount u get more amount(Rs150000) in future.

But the sale consideration was not done accordingly to the amount specified in Brouchure any one can help reg this issue, bcoz the cosumer forum has dissmissed this case saying this is a commercial one when the plot was registered as residential layout .

please hlep me any good replies will be of great help.

Your query is not clear to me but yet on my understanding to your query,I try to reply to the best of my knowlege.

 

1.Prima-facie,there is no contract between you and invester,as sell consideration was not done according in view of amounts.Therefore,it's just an offer made by you and to accept your offer is dependent upon the investor's discretion.

 

2.Brouchure is not an offer rather it's a tender to a offer.You make the offer by proposing the asked price,the acceptance of which amounts to a binding contract.

 

3.Where the purpose of any goods/services is for commercial purpose, you are not said to be a consumer within the meaning of Consumer protect Act 1986.
