Cord blood collection

My wife delivered a baby girl this march end and I have registered with leading cord blood bank for collection of Cord tissue and cord blood collection. I had informed the Blood collection agent as soon as my wife got a labour pain. Agent mentioned that they have tie up with the hospital and the Doctor would collect both the Cord blood & Cord Tissue and hand it over the next day morning as my wife was about to deliver by 5:00 AM.

Post Delivery, Doctor informed me that they couldnt collect the Cord blood as the cord is very small but they have collected the Cord Tissue. I found something fishy but couldnt argue as I just had my wife delivered the baby. Immediately, I have informed the agent and he said that they will store only the cord tissue and will refund me the charges collected for storing Cord Blood. Doctor had clearly mentioned the inability to collect blood sample since the cord is short. 

But after discharge, my wife narrated me that blood sample was collected and she heard Doctor was scolding the nurse for not collecting the sample and let it go. She was given anesthesia and couldnt recollect much but is confident that it is doctor's fault.

I approached the cord blood bank and they are refusing to pay the money intended to store Cord blood. They are claiming that they have collected the blood and is stored in a proper storage. 

How can they store the blood when the Doctor herself gave the discharge summary that it wasnt collected. I didnt get proper answer to this.

Now my questions are

1. What action can I take against the Cord Blood Bank as they are refusing to repay the amount?

2. Cord blood agent must have been present during the delivery. Due to his negligence, Valuable Cord blood is not collected? What action can be taken against Doctor or against Cord Blood Bank- Any compensation?

 

Your response would be appreciated and would like to use the lawyers in the forum (Velachery, Chennai) for my case
