If he is hindu and has ancsetral property the child has to file separate suit for partition if it is self acquired no division only maintenance.

Paramount interest of the child has to be considered by the court before granting custody to claimant parent.

Property of the minor has to be partitioned as per his / her personal laws which are different in different religions.

Two different subjects have been clubbed in the query, if it is a true story and not an examination hall question paper..
