Demand notice for recovery of outstanding dues

I had a postpaid photon plus connection  which i discontinued due to Network as well as service problems. I visited TATA office two times regarding my problems but my problem was not solved.Finally I decided to discontinue the service. 

 
I continue to get the bills after this for two months. When I refuse to pay the ammount of non usage period they sent me below notice. Please suggest what should I do now.

Dear Sir/Madam,

 

Tata Teleservices Limited, having its office at 2A, Old Ishwar Nagar, Main Mathura Road, New Delhi-110065, serve you this notice of demand, the contents whereof you may note as detailed herein below-

 

1.     Tata Teleservices Limited is engaged in the business of providing CDMA Mobile /Fixed Wireless telephony (FWT) Wireline/Pay Telephony Business (PTB) Services inter-alia in the Telecom Circle of Delhi by virtue of Licence granted by Department of Telecommunication, Ministry of Communication, Government of India.

 

2.     A phone connection was allotted and sanctioned to you on your request on a duly executed Subscriber Application Form and other related forms/documents ("Agreement" hereinafter). The aforesaid phone connection and account ID was allotted to you. You availed best of the service/s provided by Tata Teleservices Limited after activation of the said phone connection.

 

3.     As per the terms of the Agreement, you were under an obligation inter-alia to make payments of the periodic bills raised by Tata Teleservices Limited upon you in respect of the availed services. However, inspite of the receipt of the said bills, you have grossly failed to make the due payment in time. Due to the non-payment of your legitimate dues, Tata Teleservices Limited was compelled to bar/suspend/disconnect your aforesaid connection.

 

We, therefore, call upon you on behalf of Tata Teleservices Limited to pay the outstanding amount of Rs.1935 /. along with interest @ 2% per month from the due date till the realization of the amount within seven (7) days of the receipt of this notice, failing which Tata Teleservices Limited, shall be  constrained to initiate appropriate legal proceedings, criminal as well as civil, against you at your absolute costs, risk and consequences.

 

This notice shall stand withdrawn soon after your payment is realized by our company, as mentioned herein above.

if you do not wish to continue with the services then you are bound to inform them about the same. so that they could discontinue the services and you shall not be liabe to pay the amount only upto the date when you applied/requested for discontinue of services.

 

since you have suo moto stopped using the servides without sking them to stop the services, thus legally you are liable to pay the outstanding amount.

The company has sent email to you implying you have provided your email id to company. Did you provide PAN Number also?

In fact there is no need.

You have posted that:

----“Finally I decided to discontinue the service.”

Did you instruct the company top disconnect in writing under acknowledgment?

Or did you instruct in person/by phone? If yes did you obtain the transaction ID?

Uf you have instructed by phone do you have the call details: Date/time of call, phone number at which call was made, phone number from which call was made, name/designation of company personnel….???

Did you obtain the complaint/transaction id?

Do you have the token issued to customer who visits the showroom?

Now you may reply with full details and conclude that company is deficient in services and in disconnecting the connection also, and demand that they may call back the illegal bills raised by them and affirm to pay the bill of usage which is full or leftover portion till the date of disconnection.

Based on facts/details/record available with you, reply of the company you may proceed further.

As a customer you should always transact in writing preferably by letter under proper acknowledgment with seal and signature of the company.

You go for a settlement with company,You should contact them and negotiate the settlement amount.Tell them that you have informed their executives verbally,and tell them you would like to make settlement by paying 50% of outstanding dues.And no need to worry it is not a big issue.
