Divorce

The  marriage solemnised in the month of May-2008, the  wife is not properly cohabit the husband and felt regularly ill. The husband send the wife  at her parents house on Augugst 27.

Now the husband received a legal notice from wife alleged that the cruelty and terminating her pregnance and claiming the maintenance. How to made the reply to the notice.i

A one or two word answer is not sufficient. Chetan you give the allowable details. One side contentions will not give a braod spectrum. When any body using this forum must at least consider the querry as an accademical one. so that we will go to all the aspects of the issue. Pl. give the details Bai.

mr suresh,wants you  to write all  facts stating from negociation of marriage day by day full history till date.we sl advice exactly like councelling.donot hide anything.law is not always exact in family matters.if you dont want to expose all , send e mail to mr suresh.my sugession for yr betterment

Problems in marital relationship can be for various reasons.


In the case referred by you, the couple lived together for hardly 3 months.


You said the wife regularly fell ill. It may be various reasons best known to the parties. If it is due to any incurable disease and the marriage has been performed concealing such fact incurable disease, then that can be a valid ground for divorce.


You also stated that the husband sent the wife to her parents hous. But you have not stated the reason for that.


You have also stated that the husband recieved a legal notice from his wife asking for maintenance alleging cruelty. It is not clear when the notice was recieved and if any conciliator talks have taken place between the two families before and after recieving the notice after August 27 on which date the wife was sent to her parents home.


Issues relating to family matters are very delicate in nature which need to be handled with caution and care as the future of many persons in both families are of concern apart from the husband and wife themselves.

I do agree with Suresh, Pratihar  and Ramakrishna Sirs,
family matters are indeed very delicate in nature and neither party
want to discuss the same in open forum. So its better you consult a
lawyer at your place. Without  knowing the facts we cannot
express our opinions/advises in such delicate issues.
