Respected Experts,

One of my friend is facing unemployment issue due to negligence by one of the consultancy. he/she was searching for a new job and got the offer letter from consultancy for one of the reputed company in Bangalore. they told my friend to join early by taking early relieving from current organization. He/She took the early relieve after management approval and on the date of joining new company, consultancy people were telling that 'due to project hold, we are searching for new project for you'. now he don't have job. he resigned from old company and new company which he got the offer is not responding properly.

please help how to proceed on this if there is legal proceedings

As per you're query let me tell you that in such a case you're friend should sue the consultancy firm for fraud.
Section 17 of the Indian Contracts Act (ICA), 1872 defines the act of committing "Fraud".

Section 17 states that - 'FRAUD' means and includes any of the following acts committed by a party to a contract, or with his connivance, or by his agent1, with intent to deceive another party thereto or his agent, or to induce him to enter into the contract.

Since, the consultancy firm wasn't able to cope up with the promises they made to you're friend due to which he/she suffered personal loss, he/she is eligible to sue the firm for Fraud u/s 17 ICA, 1872.
