Questioner   31 August 2023

Father properties

I am a 39 year old female

My father died in 2021 without a will, My mother is alive

We are six children - 5 daughters and 1 son. We are all married each of us have children

My father  was a pastor and got countless properties in various forms : Church buildings, Church Infrastructure, Vehicles, Lands, Houses, Farms

To continue my father's Church work, my brother unanimously took up responsibility and continue to run the Churches

My father and mother also have personal properties: Houses, Lands and Farms

My brother not only exercising ownership on "so called" Church properties ( I thin they are all on my father's name) and also personal properties.

3 of us sisters want to go legally against him and get rightfully what we legally get as our share.

2 other sisters took his side, obviously my brother would have bribed or threatened them

Can you please advice me

Thanks

You should partition the property, it is better to get the details of proeprty and ask your family members to partition the property and if they refuse then file a suit for partition. It will be big problem later on. better to settle the issues now and let each share holder get its share.

Thanks for your reply

Three of us sisters tried to talk to my brother for several times, but he didnt agreed. As he have Church people support, he made their minds beleive that he is care taking Church properties but actually he is enjoying them. He calls them Church properties but it is on my late father's name or he might have transferred to his name.

I have questions

1. Can he transfer the properties from my late father's name to his name without sisters consent. My late father didn't wrote a will, as it is was sudden death

2. Can he hold the properties on his name if they are Church belongings.

3. A specific house my late father built and registered on my mother. So it not my mother's earning but passed on by my late father. Now she was brain washed by my brother and he convinced her to write off soley to him. Can she do that, can we file a case on it and get equal share?
