Flat leakage that affects only the society

Hi,

Our society has a leakage problem with several flats in the building. However, this leakage doesnt affect the owners, rather is affecting the outer wall of the building.

They want us to bear the complete charges of this repair.

Pls advise whether these charges should be borne by the society or us.

It depends on bye laws and resolutions in General body.  A society earns through contributions from members and spends for the cause of larger residents.  When there is a problem to main structure, endangering the residents, society is empowered to send a notice/circular or even take such measures taking into account the safety of building and residents.  Naturally the amount so spent must be shared by residents/owners.

Though it is the property of the society, what is society, it is the common property of all the residents/flat owners, so it becomes the responsibility  of all to maintain it, hope this conveys the meaning to your question.

Please give the following information:

1. The State in which the Society is situated

2. Is it a registered society? If so under which Act of the State is the Society registered?

3. Have you got byelaws and elected managing committee?
