Gratuity Payment under the Payment of Gratuity Act, 1972

Dear Friends,

As per Section 4 of Payment of Gratuity Act, 1972 any employee who completes continuous service of 5 years becomes eligible for gratuity payment @ of 15 days salary for per completed year of service.

If any one dies or disabled due to an accident, irrespective the 5 years criteria he/she or nominee's are entitle for gratuity payment.

One of our employee has commited suicide can his legal heirs claim gratuity?

Please help me on this.

If the employee has served the statutory period then his legal heirs are entitled to get gratuity irrespective of the manner in which he died.
