Hi,
I am undergoing legal fight with my wife for Section 125 and DV section 12 in two different cases. She has asked for huge monthly maintenance amount even more than my salary. I have following queries:
1. Can court ask me to submit my income proofs? If yes, how can I encounter it? Please share judgements, if any.
2. I am paying Loan EMI's (home loan taken prior to marriage and personal loan taken after marriage when we were living together) almost half of what I am getting monthly take home. My lawyer says there is no provision in law to consider loan EMI while determining maintenance amount and court will decide on your take home. Please inform if it's true. If not, please share some judgements in this matter, if any.
I want add that marriage was held in May, 2013 and no child is born in wedlock. And we are living apart since March, 2014
