Hi

I want to know some basic things in labour law.If some one has signed an agreement in a concern and not in a position to work there what is the legal procedure for getting relieved from the concern. Please give the reply clarifying my doubts

Your question is If a person sign in a bond & not in a position to continue the work, the legal formality to get relived.

The thing one is :- The bond its self the procedure will be given clearly. If the employee want to relive he/she has to agree the compensation like that or the notice period has to fulfill.

Otherwise it depends upon the bond which the employee signs

The Delhi shops & Establishment act 1954 will cover only the leave of an employee. The leaves as per the act are follows

Every person employed in an establishment shall be entitled

(a) to 15 days of privilege leave for one year of service, which can be accumulated to 45 days.

 

(b) To 12 days of sickness or casual in an year. (Section.22)

 

THE DELHI INDUSTRIAL ESTABLISHMENTS (NATIONAL AND FESTIVAL HOLIDAY) act will cover the National & Festival Holiday. As per the act there should be compulsory National Holiday (4days), Independence day, Republic day, May Day, Gandhi Jayanthi . For festival holiday you can choose any 6 of the festival day as per the Gazette notice.
