Maintenance in false dowry case

Hi Experts,

We belongs to middle class family. 1.5 years old married and having 1 child recently. She is higher qualified. Earlier she was working but now not working as she left the job.

She is bad women. Having 2 illegal relationship that I got to know after marriage, short-temper and ego person.

She has filled a false dowry case(498a, 3/4 dp act, 502, 503). We went to 3 times at district sanjota kendra, but seems like case will go to court.

My question is - 

1 - What punishment me and my family will get from court in worst situation?

2 - Do I have to pay any maintenance to my wife if she will demand?

3 - I want to file divorce case. I have to do it right now or Should I wait for settlement of this case first?

4 - I have a flats on my and my brother name(joint flat, brother is co-applicant) and me and my brother has taken loan on it for 8 years but only I am paying EMI. Should I transfer it to my mother before filling divorce so that she will not claim on it or what else I can do in this case?

1. nothing wrost will be happened with you engage a good intelligent lawyer for your case and act accordingly as per his advise .2. If your wife is non working woman then you have to give maintenance to her , as well as for your child . 3. better you wait for settlement. 4 . it doesn't make a difference let it to be in your name she cannot claim share in your property.

I want to file divorce case as I don't want to live with her.

 

also want my child if she wants to give. if she does not want to give that will also be ok for me.

 

My Question is?

1- What will be the good time to file divorce case. Right now parallel with dowry case OR should I wait for settlement of this case and then?

In order to obtain a divorce on the basis of adultery, an adulterous act must have taken place and the Petitioner must state that he or she finds it intolerable to continue to live with the Respondent.Showing evidences are important and your correct statement in the court.

You have not mentioned if you two are still living together or separately.  In case, you two are still living together, now would be a good time to collect evidences - audio recordings, official proofs, unofficial proofs, adultery proofs, etc. Transfer of property is highly advisable irrespective of things improve or deteriorate if you can afford it.
