Medical negligence-opinion

Dear Respected Experts,

This case is regarding seeking a clarification whether my case will be covered under medical negligency resulting claim of compensation from Hospital-

Facts-

I was injured due to road accident on Dec,12 resulting fracture and heavy wound in my left Ankle.I was admitted in a reputed Hospital in Gurgaon,Haryana.They fixed up the fracture with plates and screws but left the open wound opened. resultantly ,Luckly i prefer to take opinion in Delhi in other Hospital where after checkup Infection found in my leg and they admitted me for one week to remove infection.

My ground is-If earlier hospital do the prentive action then i should not have these problems.Further due to this improvement in leg was delayed.

Did you pay any charges at the Gurgaon hospital? If not who paid the charges? Was the accident registered by the police? Was there an FIR? How exactly did you get injured? If it was due to another vehicle, do you know the particulars?

I have paid partly and partly by incurance company,No FIR and police complaint done.I falled from byke due to night.

You can file a case in local consumer forum and ask for reimbursement of costs as well as compensation. But has the hospital given you a discharge certificate saying "obtained discharge against medical advice". If so you will have to contend with that also. Will the doctor in the second hospital support you. If so take his support. Otherwise you will have to get another doctor to support. Doctors in general will be reluctant to appear against another doctor in their fraternity.

You can also make your complaint to the Medical Council. But then at the most the doctor will be penalised. It is doubtful that you will get any compensation
