Need Assitant

Hi To all the great lawyers of this club,

I’ll like to get opinion for you all on the below scenario.

Party A has a property in posession since 1980 which belongs to a public trust in the state of Uttar Pradesh. In year 1995 an affidavit was give by the trust to Party A to use the property as long they wish and behalf of this affidavit party was submitting property tax in the development authority till date. In year 2000 few members to the trust died and remaning member files a case in court to get the trust converted as private trust. In year 2003 the trust got converted to private by a ruling given by High Court (bribing judge for sure). Party A didn’t file any objection against it.

Later after 4 years I.e. in 2007 the trust sold the complete property to a builder. Now the builder want the existing posession holder’s of the property to vacate it. So I would like to know what are the step which Party A can take in order to remain the posession holder of the property. Moreover what additional step he can take to avoid any unwanted situation given that even everyone is aware of the law situation in U.P.

Waiting for some good suggessions.

Cheers,
Anurag Pandey
