No evidence order passed

Hi Experts,

After wife failed to appear in many occasions court passed No evidence order on her DV application.

I learnt that they are now planning to come in next date.

Can she set aside the no evidence order in same court or she has to approach higher authorities?

Also what exactly is the benefit of No evidence order in DV case......my wife has already submitted chief affidavit through her lawyer.

Kindly help me understand it better and how to use it effectively.

DV is quasi criminal in nature.  The wife side is just fooling around.   They just want to delay the matter so that you will get frustrated.  Next after this they wont appear till case is posted for dismissal, wont appear in court for 1 year, you will keep roaming, they will appear on that date when DV has been posted for dismissal.  Then they will come up with a story of not being well, out of town blah blah, and sadly the magistrate will also accept whatever they say and will post it for evidence and so forth.  This kind of things happen every day in court.  Nothing to worry.  Just have patience, the DV case will go on and on [5-6 years].  All the best.
