i have filed summry suit u/o 37 of the C.P.C. and the summons was sent through Registered Post and the same is returned with remarks "Intimation". wheather such remarks is consider as "served" in the eye of law or not? can i file an application to obtain an ex parte order.
Pls. Clear my doubt......

you may proceed with substitute service and after completing the procedure of substitute service and filing affidavits for the same you may proceed with getting the suit exparte. Only agter hearing the suit ex-parte you will get ex-parte order.
