Society is asking me to pay maintenance of rs. 29k which is due from previous owner

I have purchased 26 years old house which is under gated community. 20th June I have engaged labours and mechanic to renovate the house. After continuing their work for some time they told me there is no water(Initially they got water due to overhead reserver). Upon checking with society treasurer, head mechanic came to know, association/society committee disconnected water connection as there is a due of Rs 29K from previous owner.  I directly talked with treasurer of the society, he told until I am not paying the previous due they would not resume water connection. Society treasurer repetitively saying, it’s my fault as I have not contacted with them before doing the registration. After few arguments with treasurer , I realised, they usually seat in a pump room from 11:30 AM to 12:30 PM on every Sunday. Before registering the property I visited the same three times but I never saw any designated association or society office in premises. There is no sign board and no where they mentioned their operating hours. My question is - as a new comer how could I know if seller is not guiding me. I am staying at Rajarhat and I purchased the house in Niva Park Extension, Brahmapur.

Seller did not tell much about committee and society. Whenever I have asked about maintenance bill, they told there is no pending dues from maintenance perspective and committee is very small and all are good peoples. I trusted seller's word because before registration they paid all dues of WBSEDCL electric bill, KMC tax and khajna.

After knowing about 29K maintenance due, again I have validated with seller, now she acknowledging  that they did not pay any maintenance on year 2020 onwards due to covid situation. Seller is a 64 years widow, her only daughter is staying in USA. She claimed that, she was not staying there and upon periodically checking she observed there is no maintenance from society, so she stopped paying maintenance bill. Seller appeared dishonest to me, she should tell this before registration. Let me know if I can take any legal action against seller.

Yesterday I have visitited Niva Park Extension Society office. I asked them to raise bill but they are denying to share any kind of document with me. They have humiliated my mother and asked until we are paying previous due they would not resume the water supply. In Niva Park Extn. total 79 houses are there as per committee. There is one bore well water facility through one overhead centralized tank. So I decided to stop the renovation work. I asked them to provide bill or some kind of document, because verbally it won't be possible to pay 29K amount. They will only provide money receipt upon paying the amount apart from that they won't provide any document. Moreover they are asking to pay additional 10K to become a member of the society. I agreed to give society membership upfront and asked to resume the water, but they are rigid to take the previous due first. After several argument they asked me to send application regarding water supply connection and against that they will reply with all these dues.

There is no necessity to pay the due of the previous owner.  You can complain to the Registrar/Joint Registrar of Cooperative Societies against the society.

Just file an injunction suit in the court
