To know effectiveness of bill no 151 of 2015

Respected Sirs,

 

I am enclosing copy of  bill no. 151 of  2015 published in the Gazette of India dated 06.05.2015

 

Please let me know whether it is already effective from 06.05.2015 or yet to be effective from any other later date.

What you have uploaded is a copy of the Bill that was presented to Lok Sabha for passing. Usually after the Bill is passed by both houses of Parliament, it must get President's ascent. Finally it must be notified in the official gazzete for it "to come into force". If you read the Section 1(2) of the Bill it will become clear to you. Whether the Bill has been notified or not can be checked from https://www.egazette.nic.in/

Its absolutely right. This bill has not come into effect as of now.

The bill is never made effective unless passed as Act by adopting due process. So, you will have to wait for another Gazette of India which will contain the Amenment Act after the bill is passed by both the houses and assented by the President of India. 

 

However, the courts are free to decide the existing cases based on the Supreme Court judgment dated 1st August, 2014, in the case of Dashrath Rupsingh Rathod versus State of Maharashtra and another (Criminal Appeal No. 2287 of 2009)

Respected Sirs,

Please find attached the Negotiable Instruments (amendment) Ordinance 2015 No. 6 of 2015 dated 15.06.2015. In which, It was stated under 1(2) It shall come into force at once.

Please confirm whether now onwards, jursidication can be taken on the basis of this Ordinance"

Yes, you can. Ordinance is effective from 15.06.2015, but will be subject to assent by the President of India fter passing of the bill by both the house of the Parliament. There seems no hudle in passing of the bill.
