Unauthorised access to bank account by bank employee

Bank account information has been accessed by an employee of that bank without permission and knowledge of bank account holder. That employee is having personal dispute with the bank account holder and it is obvious that he accessed his banking information to find something which he could use against him. This appears to be a clear violation of fundamental right to privacy. As no transaction has been done and no hacking has been done (because access is done by bank employee himself) , police is not keen on taking any action. There are chances that bank employee must have taken CIBIL report of account holder as well using his banking login privileges. What to do? Which sections / provisions can be highlighted so that police takes action. Thanks

The simple fact to be stated by you is how it has come to your knowledge that the bank employee had accessed such an account.

Though the employee can access accounts, it is strict as per duties allocated to him.   For example, if that employee is entrusted with cashier's duties, he is not supposed to search your loan account or download CIBIL report.  An employee working in the Agricultural /Industries section can not have access to an open savings account unrelated to his duties.

If you have enough evidence make a written online complaint immediately to the bank naming the employee and seek information as to the persons that had access to your account.

Wait for the response make a complaint to Ombudsman and also to Consumer Forum for deficiency of services as maintaining the secrecy of customer's account is fundamental principle in Banking.

Remember that complaint should not be on suspicion or doubt and your complaint must be based on facts that can be verifiable.

If you have any tangible and verifiable evidence then you had better file an FIR with the Police department. If it is only your surmise then it is useless to proceed with the matter any further.
