Exam.- in-chief of a pw has been completed since long in my 498a case but with the pretext of old age related ailments not turning up in the court for cross exam. In fact, there are so many contradictions in the evidence of this witness vis-a-vis evidence of 498awife which are of great benefit of the accused. In case this witness does not appear for cross and the evidence of the prosecution is closed by order, can accused use this evidence containing contradictions vis-a-vis evidence of main pw.
