    I can answer any question on Civil, Criminal,Contract, Property and Family laws but not on tax laws, labour laws, environmental laws, Insurance laws and international laws.

    Hi!! Myself and my wife ar living separately for he past 6 months, I have filed for a divorce in the chennai family court, however my wife subsequently filed a petition for separation. However my only daughter born on 27th Mar 2005 is inmy wife's custody and she hasn't allowed me to speak to my daughter telephonically nor meet her physically from the past 6 months. However my petition in the family court is only for divorce and not for child custody as thought my wife would agree and allow meto have a proper relationship with my daughter. However now my daughter who was closer to me then is very averse towards me as i think my wife and their family have poisoned my daughters mind. This i got to know once while i met her near the school and she did not wanted to come to me. My wife is working employee, she works from 8 am to 8 pm, she is staying with her parents and my daughter is with her taken care by he maid servant and her parents. I am currently engaged in a consultan since i lost myjob recently. However there is no issue on that irrespective of whether i have a job or not i can take care of my daughter at the same standards how i have taken care of her from her birth. Now i am contemplating to approach the madras high court for child custody. Under current situation, what are my hances of getting the child custody and what would be the implications.

    Respected Sir 1) That My father Govinda Setty bought 5000 shares of Rs10/-each in the year 1994 in private company. 2) That My father died on 29-04-2002 3) That the above mentioned shares were in the name of my father till 04-02-2007 4) That the above mentioned shares were transferred from my father name GOVINDA SETTY to BNK SHANBHAG (Director) on 05-02-2007 5) That i am legal heir of Govinda Setty till today i have not received any notice of the meeting, Director report and balance sheet of the company So, it is very clear that it is not possible to selling the share by my father in the year 2007 why because he died in the year 2002. please guide me what action i can take against company/directors and its management regarding above issue. according to companies law as well as IPC, Crpc please mention section as well thanking you sir regards rajesh badami 9844509445 email: arn44480@gmail.com

    Respected Sir crl complaint uss 323/452/395/148/149/506/120-B IPC was filed by me in which four accused were named (mentioned in complaint by name)& 20-30 accused were mentioned in complaint as "20-30 other"now court has passed summoning order against four accused u/ss 323/452/506/120-B IPC & not under sections 395/148/149 IPC by stating reason that there is only four accused are mentioned by name in complaint so being accused less than five section 395/148/149 IPC is not attracted in such position,my submission in the court was that the court can proceed under sections 392/34 in such position thereaccused are less than five in number but court decline my submission,i have a citation of supreme court in which it is clearly mentioned that mere mentioning of wrong sections in complaint is not a ground to dismiss the complaint,court can summon the accused under any section in which court after perusing complaint found that the offence is prima facie made out.please avail me legal position alongwith citations.

    author : pkm Posted On 17 July 2009 drawer of a cheque being a company liqidated as per order of high court. The payee company who has filled complaint under section 138 has also order by high court to wind-up.who will fight criminal case since official liquidator has been appointed.wheather official liquidator has a right to continue criminal proceeding. wheare as official liquidator duty is to take assests of the company & realise them & pay to the concern person / institution. i want were such type of situation will be available for reading or some case laws on them
