  • Jitendra Raval says : Rarest of Rare case under S.138
Regarding my query Sir, you wanted to know whether wife has informed in writing or not. I wouldl like to clarify that, it was the oral communication. She informed that it is misplaced and not lost. Otherwise accused might have prefer for stop payment. Since cheques where lying with a wife accused was not worried much. Besides this, the concerned account was dormant as soon as accused transfered to Delhi. I have raised certain points towards the end of query. Kidny go through it. I will wait for your reply. It is very critical case for accused as his entire creditibility and hounour is at stake. Your view points will be great help to us in deciding the way which we should adopt for defence. Kindly suggest certain Caselaws if your have in mind which can be useful in pleading the case. Thanks and regards,

  • A V Vishal says : Registration of Xerox Document
Dear Sri Palnitkarji, Greetings to you. Sir, I have joined the forum recently and have been following up the discussions here closely. I have a personal query and seek your assistance in this matter. In this forum I have replied to an query of a person who claims to have lost his original deed of Agreement of Sale and he had intended to get it registered. I suggested him to file a Police complaint about the loss and also advertise in the local newspaper, and enter into a fresh agreement of sale. However, this person wants to get the xerox of the agreement registered, I suggested him to execute an indeminity bond and along with the FIR approach the Sub registrar and prove the crendentials of the contracting parties and get the xerox document registered. As per my limited knowledge I have in registration matters, I presume that the registration authority is vested with the power to accept the said document. I want you to guide me in this matter and enlighten me on the subject. An early response in this regard will be highly appreciated. Thanks, Adv.Vishal
