20 times parking charges for relative staying in the flat

 

Respected Lawyers,

Thanks for reading this query.

I am staying in my aunt's flat in Mumbai society. The society is charging car parking @ Rs.150/- per month for members of the society, sons & daughters. However since I am a nephew the parking is being charges at Rs.100/- per day. Total 3000/- per month per car.

Due to the location of the society there is no place to park outside the society premises in a safe manner. Despite of writing to the society to allot a parking the same is denied in two AGMs.

The resolution was passed by CHS few years back & perhaps in by laws as well.

We are not getting any relief from the society.

Deputy registar has no authority in the parking matters, & I have been asked to file the case in cooperative court through owner.

Kindly suggest if there is any point & hope in going to co-op court in this matter.(any laws/court decision like this)

If society can take any decision for the common area & charges then can they decide any unreasonable amount for this?

Kindly suggest as I am getting extremely harrassed by the society.
