Alimony

husband won divorce case by removing documents from trial court file. he got married to his girlfriend, whom he had live-in relationship. out of that live in relationship they had two kids. wife is working , earning Rs 25000/- less than husband. she is a cancer patient. court ordered to pay compensation . but husband refused to pay any alimony, stating that she is working. can wife eligible for any alimony? if yes, how much? wife said that she cannot work as she used to work earlier , she needs good amount of alimony and also the amount that she spent on her husband for last 13 years, when they are together. if husband refused to pay, what will be the course of action?

Awarding maintenance is the discretaionary powers of the court.  Let her file a maintenance case against the husband stating that eventhough she is employed she is not in a position to maintain herself because of her illeness.  She needs money for the treatment.

Working lady is not entittle to claim the maintenance, but on the above said ground you can claim.
