Buying illegal flat in thane without proper chain document.

Should I buy a illegal flat in which the 2nd owner doesn't have the transaction proof between the developer and 1st owner. They have proof of sale between 1st and 2nd transaction. Also they have TMC tax paper in their name. The agent is saying they have a solution for this that the 2nd owner have to register a complaint for their document lost, then have to put an advertisement in paper for the same. And some 2 or 3 legal procedures will make it ok. The building is built in the year 1996. And purchased by 2nd owner in 2004.

Obtain a copy of the document made between the 1st owner and developer from the SRO concerned.  The copy of the document issued by the Sub Registrar will be treated as same as the original.

It appears to be a fraudulent sale process. 

You may be trapped in a scam by the fraudster agent for the sake of his commission. 

You may obtain a proper legal opinion from an experienced lawyer in the local and proceed only if recommended.

What is the status in respect other flat owners?

Does the first (rather, original) flat owners have the transaction document?

Is it that the developer had acquired the site,  constructed the flats and sold to the flat owners?

Have the flat owners joined together and  formed the cooperative socieity? If so, when?
