Key clauses to include in rental agreement to ensure vacant possession after 5 years

Hi,

We are planning to rent out our commercial premises in Tamil Nadu to a shop tenant for a fixed period of 5 years. After the 5-year term, we will need the premises back for our own use.

We are seeking advice on what important clauses or precautions we should include in the rental agreement to ensure that we can reclaim the premises smoothly and legally after the 5-year period, without facing disputes or delays.

We want to be proactive and avoid future complications based on past experiences. Any suggestions regarding key points that needs to be part of agreement, necessary legal formalities, or practical tips to minimize the risk of the tenant overstaying would be greatly appreciated.

You can consult an advocate in the local who is experienced in drafting such agreements and proceed as suggested.

You may instruct the advocate of your requirements to be kept in the agreement as terms and conditions for this rental agreement.
