Can society sale unused property ?

We have one flat in our society which was not sold by builder and remain unused for last 15 years. Our Society also 15 years old, Our society members tried to take a details from BMC office for same unused flat. But no record has been found at BMC office as well as at registrar office. So is it possible that society take ownership or authority of same flat and sale as per the market rate ?

The bye laws of the society must have an answer to this. Even if not, it has to be seen whether the state law there permits society to buy or sell property in its own name. Further this sale has to be after sanction from the Registrar and if society also registered under Trusts Act, then Commissioner. A resolution is compulsory in a general body meeting. In my opinion the unused flat is property of the builder only.
