Central bank of india debit fund from saving account

Dear Sir,

Hope are you doing well.

I have saving account with central bank of india Bhusawal Branch.

I have 2 brothers & 2 sisters.

Common land occupied by MSEB project & we got a good compensation also but by the way of the common name cheque.

One cheque received on my name ,my younger brother & yeilder  sister's name.

This common cheque amount is around 2600000.00 & same will submitted to my personal account.

Out of which 1500000 is already withdrawal & given to my brother & sister.

our Father expired in 1994 hence succession opens in 1994 itself so that  2005 amendment is not applicable.

But my sister forcing to give her share  as per 2005 amendment.

AS per 1994 amendment , her share is about 261000 only & brother share is about 1500000.

Brother is staying with sister only.

out of 1761000, 1500000 is already given to my sister & brother.

 

But now  bank is not co-operating with me to getting my fund back.

I have passbook , cheque book , Debit card & internet banking ID & passward on my single name which clearly indicates the account is in singular mode.

But bank along with my relative saying that same account is joint account .

If the account is joint account ,then bank is not authorized to give internet banking ID & passward but without any objection they are providing all banking documents.

Now bank crossing the higher limit, Bank debitted Rs.980000 from my account  without any intimation or letter giving to me  & transferred to FD which is on the name my brother & sister.

Now please guide me to take action against bank for this mis transaction. 

I have lost my share so please tell me how to stop that bank FD .

Give a cheque of Rs1,000/- drawn in your friend's  name and let it be presented across the counter, if it is returned, let payee demand cheque return memo, and keep that returned cheque, cheque return memo

1.Please provide me certified copy of account opening form disclosing mode of operation in the account.

2.Please provide me certified  copy of Ch.No...................................

3.Please provide me specific reasons for not honouring my cheques drawn by me individually.

(Let thebank state their version on record, and then file a consumer complaint before Disrict Forum for deficiency of services of not  permitting withdrawal and it will not cost you more than Rs.200/- if you appeal as party in person.

This is Bank's point of view. But legal point of view has decided by experts and if you are one of the legal heir, to-day or tomorrow you are accountable for returning of due shares to all eligible legal heirs.

If the SB account is on your name alone and not a joint account, then the bank's action is illegal, write to the higher officials about the bank manager's violations of banking rules and also approach Banking Ombudsman in case there is no proper response from the higher bank officials.
