Ours is an LLP ( owned by members of a family) are sourcing equipments from another Private Limited Company (owned by same family) and selling those things to another LLP ( also owned by same family). The last LLP exports.
The family has representation in all these 3 entities in different permutations and combinations. So conflict of interest is definitive from the perspective of each entity.
My queries :-
No 3 rd party-independent party is involved.
Pricings are decided by the same family. Absence of any 3 rd party leads to normal assumption of NO arms length pricing concept.
What AS/Taxation/Corp Laws are applicable?
