I bought a flat in gated community which has 4.83 acres of land as per sale deed. There are total 360 flats in the community. The total 4.83 acres land is registered to all 360 flat owners in the form of undivided share of land. The sum of undivided share of land to 360 flat owners is equal to 4.83 acres
In the sale deed, builder added a point where he claims that he has the right to sell or lease the commercial facilities even though the club house is build in 4.83 acres of land.
Does builder have any rights to sell or lease the commercial facilitates to outsiders ?
