This is regarding the Copy of testimony and Oral evidence recorded by the court
The court records the testimony as well as cross of witness, for example court records it as :-
'It is true to say that _____'
Or 'it is not true to say that _____'
Though there is exam-in-chief affidavit, some questions were different and were allowed but not sure whether it is recorded.
Hence, even though the copy is given to other party , those different questions do not appear in it.
So there is confusion as to exactly what is brough on the records? Opposite party needs a copy before cross-examination of the same witness.
How does court reord the exam-in-chief ? Does it just tick mark on that affidavit para-by-para?
Please advise.
