Deceased claim

if we settle the deceased claim as per the legal heir certificate issued by the Tahasildar if there is any defective who will be in problem we or the issuing authorities. please clarify.

Hi! Thanks for bringing us the question! Here it would be necessary to keep in mind two important things- 

1. Are you and the deceased both covered in the Hindu Succession Act or not?

2. What is your exact relationship with the deceased? Whether he died intestate or had Class I legal heirs before you.

If you are covered under the Hindu Succession and the deceased died intestate leaving behind no Class I heir or any heir who is entitled to a better title than you, then you can claim the property by getting your Legal Heir certificates from the competent court(District Judge). Once you get a green signal from the judge, you should not see any issues.

However, your question is not very clear and it can be answered in a better way if you provide a little more details of the matter. Hope this will give some clarification. Good Luck!

You are already aware of the defect.

You may bring the facts in the knowledge of superiors and authority that has to decide the matter e.g; AGM…………..and/or seek legal opinion from legal cell.

Thereafter proceed as advised.
