Dispute between siblings for partition of the property

Dear Sir/Madam,

Am facing issue with my sister in partition of the property (in 20X30 building 3floors and one small pent house in 3rd floor) which my grand mother wrote a will for both of their grand children i.e myself and my younger sister to divide equally.

1. She wants the property papers to her custody for which i don't agree.
2. Which is the best way to safegaurd the property documents? which should be accessable to both of us.
3. how to do the partition of the such a small land with 3 floor.

Kindly advice.

You first send her a legal notice demanding partition equally by metes and bounds, if she is not accepting the terms for amicable partition then you file a suit for partition before court.

If the property is indivisible then the court may bring the property to auction sale and will distribute the sale consideration amount equally.

Either you or your sister may release your share in the small land on the 3rd floor.  If your sister asks for a copy of the document give her a copy of the same.

It is appropriate and better to settle the issue amicably. However, if she do not agree file a suit for partition through a local prudent lawyer.

What are the property papers you are referring to?
