respected legal fraternities and friends,
need one urgent advice on asap. pls. help me.
i got married to my wife in may 2013.
she left my house without any reasons in september 2013 and never came back. then she started threatening me and forcing me to divorce her on asap in november 2013. she threatened me thru her realtive to kill me and my family members . i immediately lodged police compalint at local polce stn. the i.o. called her and warned her to stop calling and threatening me and my family members and told to go to court and take divorce from me as she told at the police stn also that she wants a divorce from me immediatedly.
i agreed to give her divorce to which she said she will send lawyers notice thru court for divorce and i told her that i will forward it to my lawyer and if i am okay with all the t & c mentioned in her notice i will sign and send it back to her thru my lawyer.
but she never sent the notice and inspite of my several request she never took her stridhan back from my house.
in may 2014 she again started harrassing me on phone and forcingme to meet her and to take her back again to my house .
in september 2014, she threatened me on phone saying that she is sending her dad to mu house to kill me and my family members thru police officers. she said her dad had a setting with police dept. and they will kill me and my family . i was scared and went to localpolice stn in mumbai where we stay and narrated all things to the officer there. he called her and her dad and gave strict warning to not to call or harrass me or any of my family members in future. they dint call me after that.
then again in this month she and her family members ar forcing me to sign on a plain seperation agreement with few witness form either side and give to them .they said they will type it on a stamp paper, notarise it and divorce will be done. i told them i will speak to my lawyer and get back to her.
my lawyers said divorce happens in court only and not on streets of mumbai thru a notarised stamp paper which is illegal.
when i refused to sign it they went to police stn. and told theooficer that i am not signing it.
i went to poilce stn and made the officer understand that divorce on mere seperation agreement on a stamp paper thru a notary is totally illegal and criminal offnese.i requested him to make my wifeand family understand the same.
now two days back. she and her brother callled me and abused me repeatedly with all cuss words and again threatened me on phone that if i dont divorce her thru seperation agreement. then they will kill me and all my family membesr. they said they dont believe in court rules about divorce. they say our marriage was not legal but we married as per the hindu rituals like sapta padi(satpheras and pooja pathh) they are also refusing to take her stridhan back.
they told me that if i dont get back to them then they will forcibly come to our house and thrash all of us.
iam confused now wot to do as they r not ready to come to court and opt for mcd. instead which take s hardly 6 to 7 months time...
now shud i lodge a second complain against her and her family members or just sign on seperation agreement and get rid off her?
wots the best solution sir?
