Divorce

I am an NRI working in Dubai, I had got married to an girl from Bombay in 2006, and was an arranged marriage howver from day one there is always a difference of opinion in every discusion. In 2009 the difference became intolerable and wife stayed back in india. Further took course of action to discuss and solve the issue howver wife didnot join the family. In 2011 had filed the petition to RCR and had 3 concelling session and after this wife mentioned that she wants divorce to the councelling who referred the petition back to court. Howver now wife is not coming to the court to file the counter?


I wish to know what line of action i can take in this situation? Since she is neither willing to join back nor providing  the necessary divorce even after mentioning the same to the councelling members.

dear querist,.

in your case if wife is delaying the process of court intentionally ,you can plea before the ld court about her intention and delay,surve her summons and if she is not coming even after the service of summons ,court can give ex party decision and if summons are not serving to her,make them served via publication and give her period to appear before the court ,if she dnt court can give ex party decision.
