Divorce by lok adalat in high court

My Dear Senior advocates,

My name is Chandra. I got married as on 15th May 2009 by black mailing without my presence of my parents or any of my relatives. Once we got married we stayed together for a period of 15 days only. But there is no any martial relation between us. Since June’2009 till now we are staying separately. As am not interested about marriage with her. The n I have filed a petition for divorce in Oct’2010. Then court was served notices several times. But she was not accept t the notice. Finally advocate commission served the notice and the same has been Acknowledged by her. But she didn’t present for the court.

Surprisingly Court was dismissed the petition instead of giving Ex-parte Divorce.

Then we have filed the Appeal against the decision given by the court as on Feb’2011. But there is no hearing or judgment till now. Meanwhile I tried to talk with her for mutual consent divorce. Now she agreed for the mutual consent divorce.

Now my question is, How to approach for divorce in high court by Lok Adalat and what is the procedure. And how much duration it will take to call for Loka adalat and after calling how many days it will take to resolve?

Or Is it fine to approach trial court by applying 6 months period mutual consent? Which option is better and through which it will resolve with in short time.

Please respond immediately sir. Its urgent.

Regards,

Chandra

Dear Chandra,

There is no provision to get divorce in Lok Adalat of any Court. Better to go for mutual consent divorce with Family Court/Lower Court. For further details u can call me at 9871158578
